Sec. 350. Certification and Comptroller General report relating to prepositioned stocks of Department of Defense

Not later than March 15, 2024, the Secretary of Defense, in coordination with the commanders of the combatant commands, shall submit to the congressional defense committees a certification in writing that the prepositioned stocks of the Department of Defense meet all operations plans, in both fill and readiness, that are in effect as of the date of the submission of the certification. Such certification shall include an identification by the Secretary of— the quantities of equipment included in such stock; whether such equipment is sufficiently modernized; the state of readiness of such equipment; and the air and missile defense capabilities protecting such equipment, if any.
If the Secretary is unable to certify that any of the prepositioned stocks of the Department meet the operations plans specified in paragraph (1), the Secretary shall include with the certification a list of the operations plans affected, a description of any measures that have been taken to mitigate any risk associated with prepositioned stock shortfalls, and an anticipated timeframe for the replenishment of the stocks. The certification required under paragraph
(1)may be submitted in classified form, but if so submitted, shall include an unclassified summary. Not later than March 15, 2024, the Comptroller General of the United States shall submit to the congressional defense committees a report on the sufficiency of the prepositioned stocks of the Department of Defense to meet all operations plans, in both fill and readiness, that are in effect as of the date of the submission of the report. Such report shall include an assessment by the Comptroller General of each of the matters listed in subparagraphs
(A)through
(D)of subsection (a)(1).
