The Secretary of Defense shall ensure that the Department of Defense maintains access to a covered category 3 subterranean training facility on a continuing basis. The Secretary of Defense may enter into a short-term lease with a provider of a covered category 3 subterranean training facility for purposes of compliance with subsection (a). In this section, the term covered category 3 subterranean training facility means a category 3 subterranean training facility (as defined in section 2869 of the National Defense Authorization Act for Fiscal Year 2023 ( Public Law 117–263 )) that is— operational on or before the date of the enactment of this Act; and deemed safe for use on such date.
