Section 1286(c)(8)(A)(iii) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 ( 10 U.S.C. 4001 note) is amended— in subclause (I), by striking or at the end; and by adding at the end of the following: to provide documented support to a defense or an intelligence agency of the applicable country; or . None of the funds authorized to be appropriated by this Act or otherwise made available for fiscal year 2024 or any subsequent fiscal year for the Department of Defense for research, development, test, and evaluation may be provided to an entity that maintains a contract between the entity and an academic institution of the People's Republic of China, the Russian Federation, or another country that— is identified on the list developed under section 1286(c)(8)(A) of the John S.
McCain National Defense Authorization Act for Fiscal Year 2019 ( 10 U.S.C. 4001 note) (as amended by subsection (a)); and is included on such list because the institution meets the criteria specified in clause
(ii)or clause
(iii)of such section. The Secretary of Defense may waive the prohibition under paragraph
(1)with respect to an entity, on a case-by-case basis, if the Secretary determines that such a waiver is appropriate. Not later than 30 days after issuing a waiver under subparagraph (A), the Secretary of Defense shall submit to the Committees on Armed Services of the Senate and the House of Representatives a report that explains the Secretary’s reasons for issuing the waiver.
