Sec. 2. Making voter registration available upon enlistment

At the time an individual enlists as a member, or is commissioned as an officer, of a covered Armed Force, the Secretary of Defense shall— ask the individual if the individual is eligible to register to vote in elections for Federal office in the State in which the individual resides; and if the individual responds by stating that the individual is eligible to register to vote in such elections, the Secretary shall, in accordance with section 7(a)(4) of the National Voter Registration Act of 1993 ( 52 U.S.C. 20506(a)(4) )— provide the individual with a mail voter registration application form; assist the individual in completing the form, unless the individual refuses such assistance; and accept the individual’s completed voter registration application form for transmittal to the appropriate State election official.
In carrying out this section with respect to any individual, the Secretary shall not— seek to influence the individual’s political preference or party registration; display any such political preference or party allegiance; make any statement to an individual or take any action the purpose or effect of which is to discourage the individual from registering to vote; or make any statement to an individual or take any action the purpose or effect of which is to lead the individual to believe that a decision to register or not to register has any bearing on the individual’s service in a covered Armed Force.
The Secretary shall seek to enter into agreements with the appropriate State election officials to enable the Secretary to carry out this section. In this section: The term covered Armed Force means the Army, Navy, Marine Corps, Air Force, or Space Force. The terms election and Federal office have the meaning given such terms in section 301 of the Federal Election Campaign Act of 1971 ( 52 U.S.C. 30101 ). The term State means each of the several States, the District of Columbia, the Commonwealth of Puerto Rico, Guam, American Samoa, the United States Virgin Islands, and the Commonwealth of the Northern Mariana Islands.
