Section 3005(e) of the Solid Waste Disposal Act ( 42 U.S.C. 6925(e) ) is amended— in paragraph (1)(A)— in clause (i), by striking or at the end; in clause (ii), by inserting or after this section, ; and by adding at the end the following: is a critical energy resource facility, ; and by adding at the end the following: For the purposes of this subsection: The term critical energy resource means, as determined by the Secretary of Energy, any energy resource— that is essential to the energy sector and energy systems of the United States; and the supply chain of which is vulnerable to disruption.
The term critical energy resource facility means a facility that processes or refines a critical energy resource. .
