The Government bears the burden of establishing whether an applicant is firmly resettled and applicants may rebut this under a preponderance of the evidence standard. Firm resettlement determinations shall focus exclusively on the existence of an offer of permanent resettlement and shall not be fulfilled by an offer of temporary, transitory, or unauthorized time in another country.
