The term institution of higher education has the meaning given that term in section 102 of the Higher Education Act of 1965 ( 20 U.S.C. 1002 ). An institution of higher education receiving Federal funds shall not grant preferential treatment to, or discriminate against, any individual or group on the basis of race, color, ethnicity, or national origin, including treatment or discrimination related to employment and student admissions.
