No State or political subdivision of a State may establish or continue in effect any law, regulation, rule, requirement, or standard that governs or regulates the compensation, publicity rights, employment status, or eligibility for competition of a student athlete or prospective student athlete, including any provision that governs or regulates the commercial use of the name, image, or likeness of a student athlete or prospective student athlete; A State or political subdivision of a State may establish and enforce laws that prohibit the unauthorized use of the name, image, and likeness of a student athlete or prospective student athlete by a third party.
