Except as otherwise provided in this Act, none of the funds provided in this title, provided by previous appropriations Acts to the Department of Housing and Urban Development that remain available for obligation or expenditure in fiscal year 2023, or provided from any accounts in the Treasury derived by the collection of fees and available to the Department of Housing and Urban Development, shall be available for obligation or expenditure through a reprogramming of funds that— For Program and Information Technology funds— initiates or creates a new program, project, or activity; eliminates a program, project, or activity; increases funds for any program, project, or activity for which funds have been denied or restricted by the Congress; proposes to use funds directed for a specific activity by either the House or Senate Committees on Appropriations for a different purpose; augments existing programs, projects, or activities in excess of $5,000,000 or 10 percent, whichever is less; or reduces existing programs, projects, or activities by $5,000,000 or 10 percent whichever is less;
For Salaries and Expenses funds— assigns personnel or hires to support the creation of a new program, project, or activity not previously included in the President's budget; increases the personnel or other resources for any program, project, or activity for which funds have been denied or restricted by the Congress; relocates or closes an office; or creates, reorganizes or restructures an office, division, branch, board or administration, which shall include the transfer of any function from one organizational unit to another organizational unit; unless prior written notification is provided to, and approval is received from the House and Senate Committees on Appropriations.
