Section 705 of the Foreign Relations Authorization Act, Fiscal Year 2000 and 2001 ( 22 U.S.C. 7401 ) is amended by striking subsection
(c)and inserting the following: The prohibition under subsection
(b)or under any other provision of law shall not apply with regard to support, including funding, information, or in-kind support, to the International Criminal Court to assist with investigations into and prosecutions related to the Situation in Ukraine or circumstances in which the Secretary of State determines that it is in the national security interest of the United States to provide such support to assist with investigations and prosecutions of genocide, war crimes, or crimes against humanity: That none of the funds made available pursuant to this subsection may be made available for the purpose of supporting investigations, apprehensions, or prosecutions of American service members and other United States citizens or nationals, consistent with the purpose of the American Servicemembers’ Protection Act of 2002 ( Provided, 22 U.S.C. 7421 et seq. ), or for the purpose of supporting investigations, apprehensions, or prosecutions of nationals of the North Atlantic Treaty Organization
(NATO)or major non-NATO allies initially designated pursuant to section 517(b) of the Foreign Assistance Act of 1961. The Secretary of State shall notify the appropriate congressional committees of any amounts provided pursuant to subsection
(c)not later than 15 days before such payment is made. Not later than 90 days after the date of the enactment of the Department of State, Foreign Operations, and Related Programs Appropriations Act, 2023, and every 90 days thereafter until September 30, 2025, the Secretary of State shall submit a report to the appropriate congressional committees that describes the use of funds made available pursuant to subsection (c). In this section: The term appropriate congressional committees means— the Committee on Foreign Relations of the Senate; the Committee on Appropriations of the Senate; the Committee on Foreign Affairs of the House of Representatives; and the Committee on Appropriations of the House of Representatives. The term International Criminal Court means the court established by the Rome Statute of the International Criminal Court, adopted by the United Nations Diplomatic Conference of Plenipotentiaries on the Establishment of an International Criminal Court on July 17, 1998. .
