Section 1832(a) of title 18, United States Code, is amended— by redesignating paragraphs
(4)and
(5)as paragraphs
(5)and (6), respectively; by inserting after paragraph
(3)the following: without authorization modifies or develops a product or digital article that could not have been modified or developed in the same way without access to such information; ; and in paragraphs
(5)and (6), as redesignated by paragraph (1), by striking through

Section 1837 of title 18, United States Code, is amended— in paragraph (1), by striking ; or and inserting a semicolon; in paragraph (2), by striking the period at the end and inserting ; or ; and by adding at the end the following: in the case of a violation of section 1832(a)(4), the offender attempts to import a product or digital article described in that section into the United States. . Section 1839 of title 18, United States Code, is amended— in paragraph (3), in the matter preceding subparagraph (A), by inserting data, after programs, ; in paragraph (6)(B), by striking ; and and inserting a semicolon; in paragraph (7), by striking the period at the end and inserting ; and ; and by adding at the end the following: the term digital article means an algorithm, digitized process, or database, or any other electronic technology that generates, stores, or processes data. .
