Section 202(c) of the Department of Energy Organization Act ( 42 U.S.C. 7132(c) ) is amended— in paragraph (1)— by inserting
(A)after
(1); by striking shall be appointed and all that follows through Code. and inserting the following: “shall— be appointed by the President, by and with the advice and consent of the Senate; and serve— except as provided in subclause (II), for a term of not more than 5 years; or until a successor is appointed, by and with the advice and consent of the Senate. ; and by adding at the end the following: A person appointed to serve as the Under Secretary for Nuclear Security may continue to serve in that position after the expiration of the person’s term under subparagraph (A)(ii) until a successor is appointed, by and with the advice and consent of the Senate. ; by redesignating paragraphs
(2)and
(3)as paragraphs
(3)and (4), respectively; and by inserting after paragraph
(1)the following new paragraph (2): The Under Secretary for Nuclear Security shall be compensated at the rate provided for at level III of the Executive Schedule under section 5314 of title 5, United States Code. . The amendments made by paragraph
(1)apply with respect to an individual appointed to serve as the Under Secretary for Nuclear Security on or after January 20, 2023. Section 3241A of the National Nuclear Security Administration Act ( 50 U.S.C. 2441a ) is repealed. The table of contents for the National Nuclear Security Administration Act is amended by striking the item relating to section 3241A.
