Beginning on the date that is 90 days after the date of the enactment of this Act, the President shall impose the sanctions described in section 808 on any foreign person that the President determines, while acting for or on behalf of the Government of the People’s Republic of China, knowingly— ordered or engaged directly in activities interfering significantly in a democratic process in Taiwan; or with the objective of destabilizing Taiwan, engaged directly in, or ordered— malicious cyber-enabled activities; or any military exercise that crossed that middle line in the Taiwan Strait.
The President may waive the application of sanctions under this section if the President submits to the appropriate committees of Congress a written determination that such waiver is in the national interests of the United States.
