Section 40904 of the Infrastructure Investment and Jobs Act ( 43 U.S.C. 3204 ) is amended— in subsection (a)(1)(B)— by striking the period at the end and inserting ; or ; by striking
(B)a unit and inserting (B)(i) a unit ; and by adding at the end the following: in the case of reserved or transferred works located within the Platte River Basin, the reserved or transferred works had a structural failure in Bureau of Reclamation infrastructure resulting in a declaration of emergency by the applicable State during the 3-year period ending on the date of enactment of this Act. ; and by adding at the end the following: In addition to amounts otherwise made available to carry out subsection (a), there is authorized to be appropriated to carry out that subsection $100,000,000 for fiscal year 2023, to remain available until expended. .
