Sec. 346. Waiver of non-Federal share of damages related to certain contract claims

In a case in which the Armed Services Board of Contract Appeals or a court of competent jurisdiction rendered a decision on a date that was at least 20 years before the date of enactment of this Act awarding damages to a contractor relating to the adjudication of claims arising from the construction of general navigation features of a project carried out under section 107 of the River and Harbor Act of 1960 ( 33 U.S.C. 577 ), notwithstanding the terms of the Project Partnership Agreement, the Secretary shall waive payment of the share of the non-Federal interest of such damages, including attorney's fees, if the Secretary— terminated construction of the project prior to completion of all features; and has not collected payment from the non-Federal interest before the date of enactment of this Act.
