In addition to any other access to criminal history records authorized for noncriminal justice purposes under the National Criminal History Access and Child Protection Act ( 34 U.S.C. 40311 et seq. ), the Attorney General and the Director of the Federal Bureau of Investigation shall provide the Secretary of Homeland Security, for purposes relating to immigration and naturalization matters, with— direct access to criminal history records without submission of positive identification, including name check access to the Interstate Identification Index System; and access to sealed record information and any other criminal history information on the same terms as are provided to an agency performing a criminal justice or law enforcement purpose.
Terms used in subsection
(a)shall have the meanings provided under section 213 of the National Criminal History Access and Child Protection Act ( 34 U.S.C. 40312 ).
