Section 1702 of the Energy Policy Act of 2005 ( 42 U.S.C. 16512 ) is amended— by redesignating subsections
(i)through
(q)as subsections
(j)through (r), respectively; and by inserting after subsection
(h)the following: The Secretary may not make a guarantee under this title for a project if the borrower has previously defaulted on an obligation guaranteed under this title. . Section 136(d) of the Energy Independence and Security Act of 2007 ( 42 U.S.C. 17013(d) ) is amended by adding at the end the following: The Secretary may not provide a loan under this subsection to an applicant for the loan if the applicant has previously defaulted on a loan provided under this subsection. .
