Section 317(a) of the National Defense Authorization Act for Fiscal Year 2010 ( Public Law 111–84 ; 10 U.S.C. 2701 note) is amended by adding at the end the following new paragraph: The Secretary of Defense may exempt a location from the prohibition under paragraph
(1)if the Secretary determines it is in the paramount interest of the United States to do so. The Secretary may not delegate the authority under subparagraph (A). .
