Subject to paragraph (2), a covered entity shall not deny products or services to an individual because the individual exercises a right established under subparagraph (A), (B), or
(D)of section 103(a)(1). A covered entity— shall not be in violation of paragraph
(1)with respect to a product or service and an individual if the exercise of a right described in such paragraph by the individual precludes the covered entity from providing such product or service to such individual; and may offer different types of pricing and functionalities with respect to a product or service based on an individual's exercise of a right described in such paragraph. The rights and obligations created under section 103 may not be waived in an agreement between a covered entity and an individual.
