Nothing in this subtitle shall be construed to— require the disclosure of information, records, or reports that are exempt from public disclosure under section 552 of title 5, United States Code (commonly known as the Freedom of Information Act ), or that may be withheld under section 552a of title 5, United States Code (commonly known as the Privacy Act of 1974 ); or impose any affirmative duty on the Director to review congressionally mandated reports submitted for publication to the reports online portal for the purpose of identifying and redacting such information or records.
Nothing in this subtitle shall be construed to require the publication, on the online portal or otherwise, of any report containing information— that is exempt from disclosure under section 552 of title 5, United States Code, or that may be withheld under section 552a of title 5, United States Code; that is classified; that is law enforcement sensitive; or the public release of which could have a harmful effect on national security. The inspector general of each Federal agency, except for an inspector general belonging to an element of the intelligence community, as defined in section 3 of the National Security Act of 1947 ( 50 U.S.C. 3003 ), shall be responsible for the submission of their reports to the Director.
