Section 22907 of title 49, United States Code, is amended— in subsection (b)— in paragraph (1), by inserting (including the District of Columbia) after State ; in paragraph (6), by inserting rail carrier and intercity rail passenger transportation are before defined ; by redesignating paragraphs
(8)through
(11)as paragraphs
(10)through (13), respectively; and by inserting after paragraph
(7)the following: An association representing 1 or more railroads described in paragraph (7). ; A federally recognized Indian Tribe. ; in subsection (c)— in paragraph (3), by adding or safety after congestion ; in paragraph (6), by striking and and inserting or ; by redesignating paragraphs
(11)and
(12)as paragraphs
(12)and (13), respectively; by inserting after paragraph
(10)the following: The development and implementation of measures to prevent trespassing and reduce associated injuries and fatalities. ; and by inserting after paragraph (13), as redesignated, the following: Research, development, and testing to advance and facilitate innovative rail projects, including projects using electromagnetic guideways in an enclosure in a very low-pressure environment. The preparation of emergency plans for communities through which hazardous materials are transported by rail. ; and in subsection (h), by adding at the end the following: Applicants may use costs incurred previously for preliminary engineering associated with highway-rail grade crossing improvement projects under subsection (c)(5) and trespassing prevention projects under subsection (c)(11) to satisfy the non-Federal share requirements. . The amendments made by subsection
(a)may not be construed to affect any grant, including any application for a grant, made under section 22907 of title 49, United States Code, before the date of enactment of this Act. Section 22907(l)(1)(A) of title 49, United States Code, is amended by inserting , including highway construction over rail facilities as an alternative to construction or improvement of a highway-rail grade crossing, after under chapter 227 . The amendment made by paragraph
(1)shall apply to amounts remaining under section 22907(l) of title 49, United States Code, from appropriations for prior fiscal years.
