Section 22908 of title 49, United States Code, is amended— by amending subsection
(a)to read as follows: In this section: Notwithstanding section 22901(1), the term applicant means— a State, including the District of Columbia; a group of States; an entity implementing an interstate compact; a public agency or publicly chartered authority established by 1 or more States; a political subdivision of a State; a federally recognized Indian Tribe; Amtrak or another rail carrier that provides intercity rail passenger transportation; any rail carrier in partnership with at least 1 of the entities described in subparagraphs
(A)through (F); and any combination of the entities described in subparagraphs
(A)through (F). The term operating assistance , with respect to any route subject to section 209 of the Passenger Rail Investment and Improvement Act of 2008 ( Public Law 110–432 ), means any cost allocated, or that may be allocated, to a route pursuant to the cost methodology established under such section or under section 24712. ; in subsection (c)(3), by striking 3 years each place such term appears and inserting 6 years ; in subsection (d)— in paragraph (8), by striking and ; in paragraph (9), by striking the period at the end and inserting ; and ; and by adding at the end the following: for routes selected under the Corridor Identification and Development Program and operated by Amtrak. ; and in subsection (e)— in paragraph (1)— by striking assistance ; and by striking 3 years and inserting 6 years (including for any such routes selected for funding before the date of enactment of the ; and Passenger Rail Expansion and Rail Safety Act of 2021 ) in paragraph (3), by striking subparagraphs (A), (B), and
(C)and inserting the following: 90 percent of the projected net operating costs for the first year of service; 80 percent of the projected net operating costs for the second year of service; 70 percent of the projected net operating costs for the third year of service; 60 percent of the projected net operating costs for the fourth year of service; 50 percent of the projected net operating costs for the fifth year of service; and 30 percent of the projected net operating costs for the sixth year of service. .
