An entity procuring a covered product pursuant to this Act shall ensure that the procurement— is conducted in compliance with all applicable laws regarding fair and open competition in contracting; is subject to appropriate cost controls; provides for whistleblower protections for employees of contractors and subcontractors; requires contractors and subcontractors to retain records pertinent to contract performance; requires contractors to submit to the entity audited financial statements covering the contract performance period; and is conducted in compliance with section 552 of title 5, United States Code (commonly known as the Freedom of Information Act ) and other applicable open records laws.
