Sec. 374. Modification to minimum capital investment for certain depots

Section 2476 of title 10, United States Code, is amended— in subsection (a)— by striking Each fiscal year and inserting
(1)Each fiscal year ; by striking six and inserting eight ; and by inserting after paragraph (1), as designated by subparagraph (A), the following new paragraph: Of the amount required to be invested in the capital budgets of the covered depots of a military department under paragraph
(1)for each fiscal year— 75 percent shall be used for the modernization or improvement of the efficiency of depot facilities, equipment, work environment, or processes in direct support of depot operations; and 25 percent shall be used for the sustainment, restoration, and modernization (as such terms are defined in the Department of Defense Financial Management Regulation 7000.14–R, or successor regulation) of existing facilities or infrastructure. ; in subsection (b), by striking , but does not include funds spent for sustainment of existing facilities, infrastructure, or equipment ; by redesignating subsections

(e)as subsections
(d)through (f); by inserting after subsection
(b)the following new subsection: In identifying amounts to invest pursuant to the requirement under subsection (a)(1), the Secretary of a military department shall comply with all applicable requirements of sections 129 and 129a of this title. ; and in subsection (e)(2), as redesignated by paragraph (3), by adding at the end the following new subparagraph: A table enumerating, for the period covered by the report, the amounts invested to meet the requirement under subsection (a)(1), disaggregated by funding source and whether the amount is allocated pursuant to subparagraph
(A)or subparagraph
(B)of subsection (a)(2). . Such section is further amended in subsections
(d)and (e), as redesignated by subsection (a)(3), by striking subsection
(a)and inserting subsection (a)(1) each place it appears. Section 2861(b) of title 10, United States Code, is amended— by striking subsection
(e)of section 2476 and inserting subsection
(f)of section 2476 ; and by striking subsection
(a)of such section and inserting subsection (a)(1) of such section . The amendments made by this section shall apply with respect to fiscal years beginning on or after October 1, 2023.
