In this Act: The term byproduct has the meaning given such term in section 7002(a) of the Energy Act of 2020 ( 30 U.S.C. 1606(a) ). The term critical mineral has the meaning given such term in section 7002(a) of the Energy Act of 2020 ( 30 U.S.C. 1606(a) ). The term Indian Tribe has the meaning given such term in section 4 of the Indian Self-Determination and Education Assistance Act ( 25 U.S.C. 5304 ). Except as otherwise provided, the term Secretary means the Secretary of the Interior.
The term State means— a State; the District of Columbia; the Commonwealth of Puerto Rico; Guam; American Samoa; the Commonwealth of the Northern Mariana Islands; and the United States Virgin Islands. The term lead agency means the agency with primary responsibility for issuing a mineral exploration or mine permit for a project.
