Section 9(j) of the Richard B. Russell National School Lunch Act ( 42 U.S.C. 1758(j) ) is amended— in paragraph (1)— by striking to purchase unprocessed agricultural products, both locally grown and locally raised ; and by striking the semicolon at the end and inserting the following: , to purchase unprocessed agricultural products that were— locally grown and locally raised; produced in an environmentally sustainable manner; produced by a certified organic farm or ranch; produced by an underserved or limited resource producer; produced by a small or mid-sized farm that is structured as a family farm; produced by a farm with employees who, as permitted by law, are represented by a collective bargaining agreement or memorandum of understanding; produced by a farm participating in a worker justice certification program; or produced by a farm participating in an independent animal welfare certification program; ; by amending paragraph
(3)to read as follows: allow institutions receiving funds under this Act and the Child Nutrition Act of 1966 ( 42 U.S.C. 1771 et seq. ), including the Department of Defense Fresh Fruit and Vegetable Program, to— use a geographic preference for the procurement of unprocessed agricultural products, both locally grown and locally raised; or use locally grown, locally raised, or locally caught as a product specification; and procure unprocessed agricultural products that are produced— in an environmentally sustainable manner; by a certified organic farm or ranch; by an underserved or limited resource producer; by a small or mid-sized farm that is structured as a family farm; by a farm with employees who, as permitted by law, are represented by a collective bargaining agreement or memorandum of understanding; by a farm participating in a worker justice certification program; or by a farm participating in an independent animal welfare certification program. ; and by adding at the end the following: In this subsection: The term beginning farmer or rancher has the meaning given such term in section 343(a) of the Consolidated Farm and Rural Development Act ( 7 U.S.C. 1991(a) ). The term family farm has the meaning given such term in section 4284.902 of title 7, Code of Federal Regulations (as in effect on the date of the enactment of this paragraph). The term underserved producer means an individual (including a member of an Indian Tribe) that is— a beginning farmer or rancher; a veteran farmer or rancher; or a socially disadvantaged farmer or rancher. The term veteran farmer or rancher has the meaning given such term in section 2501(a) of the Food, Agriculture, Conservation, and Trade Act of 1990 ( 7 U.S.C. 2279(a) ). .
