Section 17(h)(1)(C) of the Child Nutrition Act of 1966 ( 42 U.S.C. 1786(h)(1)(C) ) is amended by adding at the end the following: During an emergency period for which the Secretary determines that, with respect to a State, access to safe drinking water is impacted and provision of safe drinking water is reasonably necessary to ensure safe preparation of infant formula, a State or local agency may use amounts made available under clause
(i)to purchase and distribute safe drinking water to program participants. In this clause, the term emergency period means a period during which there exists— a major disaster declared by the President under section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act ( 42 U.S.C. 5170 ); an emergency declared by the President under section 501 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act ( 42 U.S.C. 5191 ); a public health emergency declared by the Secretary of Health and Human Services pursuant to section 319 of the Public Health Service Act ( 42 U.S.C. 247d ); or any renewal of such a public health emergency pursuant to such section 319. .
