Sec. 701. Clarification of coverage of artificial reproductive services for certain TRICARE beneficiaries

Section 1074(c)(4) of title 10, United States Code, is amended by adding at the end the following new subparagraphs: In providing for the coverage under this subsection of artificial reproductive services to any member of a covered armed force who incurs a serious injury or illness on active duty as specified in subparagraph (A), the Secretary of Defense shall ensure that the coverage of such services, including gamete donation and surrogacy services, is provided without regard to whether the member is married to a spouse of the same gender, married to a spouse of the opposite gender, or unmarried.
In this paragraph, the term covered armed force means the following: The Army. The Navy. The Marine Corps. The Air Force. The Space Force. .
