Section 1562 of title 10, United States Code, is amended by adding at the end the following new subsection: In a case in which the information maintained and reported by the Secretary of a military department under subsection
(b)includes the findings of an Incident Determination Committee, the Secretary may not share such findings with any party other than the administrator of the database under subsection (a). The Secretary of Defense may waive the prohibition under paragraph
(1)on a case-by-case basis if the Secretary determines that it is necessary to share the findings of an Incident Determination Committee with a member of the Armed Forces or a civilian employee of the Department of Defense acting within the scope of their official duties. In this subsection, the term Incident Determination Committee means a committee established at a military installation that is responsible for reviewing a reported incident of domestic violence and determining whether such incident constitutes serious harm to the victim according to the applicable criteria of the Department of Defense. .
