Sec. 3514. Requirements relating to training of Merchant Marine Academy cadets on certain vessels

Subsection
(b)of section 51307 of title 46, United States Code, is amended to read as follows: The Secretary shall require an operator of a vessel participating in the Maritime Security Program under chapter 531 of this title, the Cable Security Fleet under chapter 532 of this title, or the Tanker Security Fleet under chapter 534 of this title to— carry on each Maritime Security Program vessel, Cable Security Fleet vessel, or Tanker Security Fleet vessel 2 United States Merchant Marine Academy cadets, if available, on each voyage; and implement and adhere to policies, programs, criteria, and requirements established pursuant to section 51322 of this title. Failure to implement or adhere to the policies, programs, criteria, and requirements referred to in paragraph (1)(B) may, as determined by the Maritime Administrator, constitute a violation of an operating agreement entered into under chapter 531, 532, or 533 of this title and the Maritime Administrator may— require the operator to take corrective actions; or withhold payment due to the operator until the violation, as determined by the Maritime Administrator, has been remedied. Any payment withheld pursuant to paragraph (2)(B) may be paid, upon a determination by the Maritime Administrator that the operator is in compliance with the policies, programs, criteria, and requirements referred to in paragraph (1)(B). . (2)of subsection
(b)of section 51307, as amended by paragraph (1), shall apply with respect to any failure to implement or adhere to the policies, programs, criteria, and requirements referred to in paragraph (1)(B) of such subsection that occurs on or after the date that is one year after the date of the enactment of this Act. (c)of such section is amended— in the subsection heading by striking and inserting Military sealift command vessels ; Government-owned vessels in paragraph (1), by redesignating subparagraphs
(A)and
(B)as clauses
(i)and (ii), respectively, and adjusting the margins accordingly; by redesignating paragraphs
(1)and
(2)as subparagraphs
(A)and (B), respectively, and adjusting the margins accordingly; by inserting before subparagraph (A), as so redesignated, the following: Consistent with the purpose of the United States Merchant Marine Academy, as described in section 51301(b) of this chapter, vessels owned or chartered by the United States Government, including vessels of the United States Coast Guard, United States Navy, Military Sealift Command, are proper vessels for training cadets. ; in subparagraph (A), as so redesignated, by striking paragraph
(2)and inserting subparagraph
(B); and in subparagraph (B), as so redesignated, by striking paragraph
(1)and inserting subparagraph
(A). Title 46, United States Code, is further amended— in section 53106(a)(2), by inserting or section 51307(b) after this section ; in section 53206(a)(2), by inserting or section 51307(b) after this section ; and in section 53406(a), by inserting or section 51307(b) after this section .
