Sec. 1074. Public availability of reports

Section 122a(b)(2)(D) of title 10, United States Code, is amended— by striking the period at the end and inserting , if the Secretary— ; by adding at the end the following new clauses: gives public notice that the report will be withheld pursuant to such determination; and submits to the congressional defense committees the reason for the determination that the information should not be made available to the public. . Not later than 180 days after the date of the enactment of this Act, the Secretary of Defense shall submit to the congressional defense committees, and make publicly available on an appropriate website of the Department of Defense, a report on the implementation of section 122a of title 10, United States Code, as amended by subsection (a).
Such report shall address— the procedures under which members of the public may request a covered report under subsection (a)(2) of such section 122a; and the procedures and criteria under which the Secretary determines that a report that would otherwise be a covered report should not be made publicly available pursuant to subsection (b)(2)(D) of such section, as amended by subsection (a).
