Congress finds the following: Both Russia and China have demonstrated the capability to target, degrade, and destroy satellites on orbit, whether through kinetic or nonkinetic means. As recently as November 15, 2021, Russia demonstrated a direct ascent antisatellite weapon. Also in 2021, China successfully grappled a satellite and dragged the satellite out of its orbit to another location in space, a capability that could be used on any other object in space, including satellites of the Department of Defense.
Not later than 90 days after the date of the enactment of this Act, the Secretary of Defense, in coordination with the Director of National Intelligence, shall make publicly available a strategy containing the actions that will be taken to defend and protect on-orbit satellites of the Department of Defense and the intelligence community from the capabilities of adversaries to target, degrade, or destroy satellites. The Secretary shall— make the strategy under paragraph
(1)publicly available in unclassified form; and submit to the appropriate congressional committees an annex, which may be submitted in classified form, containing supporting documents to the strategy. In this section: The term appropriate congressional committees means— the congressional defense committees; and the Permanent Select Committee on Intelligence of the House of Representatives and the Select Committee on Intelligence of the Senate. The term intelligence community has the meaning given that term in section 3(4) of the National Security Act of 1947 ( 50 U.S.C. 3003(4) ).
