Clause
(iii)of section 1286(c)(8)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 ( 10 U.S.C. 2358 note; Public Law 115–232 ) is amended— in subclause (I), by striking or at the end; and by adding at the end the following: to provide documented support to a defense or an intelligence agency of the applicable country; or . None of the funds authorized to be appropriated by this Act or otherwise made available for fiscal year 2023 or any subsequent fiscal year for the Department of Defense for research, development, test, and evaluation may be provided to an entity that maintains a contract between the entity and a Chinese or Russian academic institution identified on the list developed under section 1286(c)(8)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 by reason of meeting the requirements of clause
(ii)or
(iii)(as amended by subsection (a)) of such section. The Secretary of Defense may waive the prohibition on funds under this subsection with respect to an entity if the Secretary determines that such a waiver is appropriate.
