Sec. 3117. Prohibition on availability of funds to reconvert or retire W76–2 warheads

Except as provided in subsection (b), none of the funds authorized to be appropriated by this Act or otherwise made available for fiscal year 2023 for the National Nuclear Security Administration may be obligated or expended to reconvert or retire a W76–2 warhead. The Administrator for Nuclear Security may waive the prohibition in subsection
(a)if the Administrator, in consultation with the Secretary of Defense, and the Chairman of the Joint Chiefs of Staff, certifies in writing to the congressional defense committees— that Russia and China do not possess naval capabilities similar to the W76–2 warhead in the active stockpiles of the respective country; and that the Department of Defense does not have a valid military requirement for the W76–2 warhead.
