The Federal share of any portion of the cost to design and construct the project for coastal storm risk management, South Shore of Staten Island, Fort Wadsworth to Oakwood Beach, New York, authorized by this Act, that exceeds the estimated total project cost specified in the project partnership agreement for the project, signed by the Secretary on February 15, 2019, shall be 90 percent. Not later than 90 days after the last day of the covered period, the Secretary shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate, a request for deauthorization of the project for hurricane and storm damage risk reduction, Charleston Peninsula, South Carolina, authorized by this Act, if the non-Federal interest has not entered into a project partnership agreement for the project, or a separable element of the project, prior to such last day.
In this subsection, the term covered period means the period beginning on the date of enactment of this Act and ending on the date that is— 10 years after the date of enactment of this Act; or 10 years after the date on which a design agreement for the project described in paragraph
(1)is executed, if such design agreement is executed prior to the date that is 10 years after the date of enactment of this Act.
