Section 738 of the National Defense Authorization Act for Fiscal Year 2022 ( Public Law 117–81 ; 135 Stat. 1801) is amended— in subsection (b)(3), by striking none of whom may be and all that follows through the closing period and inserting none of whom may be— a member of an Armed Force; or a civilian employee of the Department of Defense, unless the individual is a former member of an Armed Force. . by redesignating subsections
(f)through
(h)as subsections
(g)through (i), respectively; and by inserting after subsection
(e)the following new subsection (f): Except as provided in paragraph (2), the Secretary may compensate members of the committee established under subsection
(a)for the work of such members for the committee. A member of the committee established under subsection
(a)who is a civilian employee of the Department of Defense and a former member of an Armed Force may not receive compensation under paragraph (1). A member of the committee established under subsection
(a)who receives compensation under paragraph
(1)shall not be considered a civilian employee of the Department of Defense for purposes of subsection (b)(3)(B). .
