Section 5725 of the Damon Paul Nelson and Matthew Young Pollard Intelligence Authorization Act for Fiscal Years 2018, 2019, and 2020 ( 50 U.S.C. 3024 note; Public Law 116–92 ) is amended— in subsection (a), in the matter before paragraph (1)— by striking The Director of National Intelligence and the Director of the Federal Bureau of Investigation and inserting The Director of the Federal Bureau of Investigation ; by inserting the Director of National Intelligence, before the Under Secretary ; and by striking Directors determine and inserting Director of the Federal Bureau of Investigation determines ; by redesignating subsections
(b)and
(c)as subsections
(d)and (e), respectively; by inserting after subsection
(a)the following: The Director of the Federal Bureau of Investigation, in collaboration with the Director of National Intelligence, the Under Secretary of Homeland Security for Intelligence and Analysis, and the heads of such other Federal, State, or local agencies as the Director of the Federal Bureau of Investigation determines appropriate, and in accordance with applicable law and policy, shall conduct a pilot program designed to implement subsection (a)(1)(A) with respect to the National Capital Region. The Director of the Federal Bureau of Investigation shall— commence carrying out the pilot program required by paragraph
(1)not later than 180 days after the date of the enactment of the Intelligence Authorization Act for Fiscal Year 2023 ; and complete the pilot program not later than 2 years after the date on which the Director commences carrying out the pilot program under subparagraph (A). The Director of the Federal Bureau of Investigation shall notify the majority leader of the Senate, the minority leader of the Senate, the Speaker of the House of Representatives, the minority leader of the House of Representatives, and the Capitol Police Board of— the placement of sensors designed to identify International Mobile Subscriber Identity-catchers capable of conducting surveillance against the United States Capitol or associated buildings and facilities; and the discovery of any International Mobile Subscriber Identity-catchers capable of conducting surveillance against the United States Capitol or associated buildings and facilities and any countermeasures against such International Mobile Subscriber Identity-catchers. ; and in subsection (d), as redesignated by paragraph (2)— in the matter before paragraph (1), by striking Prior and all that follows through Investigation and inserting Not later than 180 days after the date on which the Director of the Federal Bureau of Investigation determines that the pilot program required by subsection (b)(1) is operational, the Director ; in paragraph (1), by striking within the United States ; and in paragraph (2), by striking by the intelligence community and inserting deployed by the Federal Bureau of Investigation .
