Section 51309 of title 46, United States Code, is amended— in subsection (a)(2)— by inserting able or before allowed ; by striking only because of physical disqualification may and inserting solely due to a documented medical or psychological condition shall ; and in the paragraph heading, by inserting after or psychological ; and physical by adding at the end the following new subsection: In this section the term documented medical or psychological condition means, with respect to an individual, a physical disqualification or psychological condition, including a mental health condition arising from sexual assault or sexual harassment, for which the individual has been treated or is being treated by a medical or psychological provider. .
