Sec. 601. Prohibition on certain small business concerns

The Administrator may not provide assistance under any program of the Administration to the following: An entity primarily engaged in lobbying activities, as defined in section 3 of the Lobbying Disclosure Act of 1995 ( 2 U.S.C. 1602 ). An entity established for the purpose of conducting public policy research or for engaging in policy advocacy or political strategy, or that otherwise is known as a think tank . An entity— organized under the laws of the People’s Republic of China or the Special Administrative Region of Hong Kong; for which the headquarters or the principal place of business is located in the People’s Republic of China, including the Special Administrative Region of Hong Kong; for which an entity described in subparagraph
(B)owns or holds, directly or indirectly, not less than 20 percent of the economic interest of the business concern or entity, including as equity shares or a capital or profit interest in a limited liability company or partnership; or that retains, as a member of the board of directors of the entity, an individual who is a resident of the People’s Republic of China, including the Special Administrative Region of Hong Kong. A person required to submit a registration statement under section 2 of the Foreign Agents Registration Act of 1938, as amended ( 22 U.S.C. 612 ). A labor organization that is described in section 501(c)(5) of the Internal Revenue Code of 1986 and that is exempt from taxation under section 501(a) of such Code. The Planned Parenthood Federation of America, Inc., or any affiliate or clinic of Planned Parenthood Federation of America, Inc. A person convicted of an offense relating to a misdemeanor or felony assault of a law enforcement officer, or convicted of a felony for actions during or in connection with a riot that resulted in the destruction of a small business concern (as defined under section 3 of the Small Business Act ( 15 U.S.C. 632 )).
