Section 51309 of title 46, United States Code, is amended by adding at the end the following: The Secretary may modify or waive the requirements of section 51306(a)(2) for students who provide reasonable concerns with obtaining a merchant mariner license, including fear for safety while at sea after instances of trauma, medical condition, or inability to obtain required sea time or endorsement so long as such inability is not due to a lack of proficiency or violation of Academy policy. The issuance of a modification or waiver under this subsection shall not delay or impede graduation from the Academy. .
