In addition to amounts otherwise available, there is appropriated to the Environmental Protection Agency for fiscal year 2022, out of any money in the Treasury not otherwise appropriated, $125,000,000, to remain available until expended, for carrying out section 220 of the Federal Water Pollution Control Act ( 33 U.S.C. 1300 ), in accordance with subsection (b), which funds may be used to make grants under such section on the condition that— a project carried out using such funds shall, to the maximum extent practicable, maximize the avoidance, minimization, or mitigation of climate change impacts on, and of, any constructed part of the project (including through the implementation of technologies to recover and reuse energy produced in the treatment of wastewater); and all of the iron and steel used in the project are produced in the United States in accordance with section 608 of such Act ( 33 U.S.C. 1388 ).
For purposes of subsection (a)— the limitation in section 220(d)(1) of the Federal Water Pollution Control Act (as in effect on September 1, 2021), as it applies to the receipt of planning or design funds, shall not apply with respect to eligibility for a grant under this section; and the requirements of sections 220(d)(2) and
(e)of such Act (as in effect on September 1, 2021) shall not apply to the making of a grant under this section.
