The Secretary of Energy shall remain responsible and liable for the management and use of the subsurface estate of the Shoal Site, including all activities conducted with respect to the subsurface estate. Pursuant to the withdrawal and reservation made by section 3011(a)(1) of the Military Lands Withdrawal Act of 1999 (title XXX of Public Law 106–65 ; 113 Stat. 885), the Secretary of the Navy shall be responsible for the management and use of the surface estate of the Shoal Site.
