Not later than 180 days after the date of the enactment of this Act, the Secretary of State, in consultation with the Secretary of the Treasury, shall submit to the appropriate congressional committees a determination, including a detailed justification, regarding whether any member of the Chinese Communist Party
(CCP)Politburo satisfies the criteria for the application of sanctions pursuant to any of the following: Section 108 of this Act. Executive Order 13694 ( 50 U.S.C. 1701 note; relating to blocking property of certain persons engaged in significant malicious cyber-enabled activities). The Global Magnitsky Human Rights Accountability Act ( 22 U.S.C. 2656 note). The Uyghur Human Rights and Policy Act of 2020 ( Public Law 116–145 ). The Hong Kong Human Rights and Democracy Act of 2019 ( Public Law 116–76 ). The determination required by subsection
(a)shall be submitted in unclassified form but may contain a classified annex. In this section, the term appropriate congressional committees means— the Committee on Armed Services, the Committee on Foreign Affairs, the Committee on Financial Services, and the Committee on the Judiciary of the House of Representatives; and the Committee on Armed Services, the Committee on Foreign Relations, the Committee on Banking, Housing, and Urban Affairs, and the Committee on the Judiciary of the Senate.
