Section 3(l)(5) of the Federal Deposit Insurance Act ( 12 U.S.C. 1813(l)(5) ) is amended— in subparagraph (B), by striking ; and and inserting a semicolon; in subparagraph (C), by striking the period at the end and inserting ; and ; and by adding at the end the following: any— digital asset (as defined in section 1a of the Commodity Exchange Act (7 U.S.C 1a)); or digital asset security (as defined in section 3(a) of the Securities Exchange Act of 1934 ( 15 U.S.C. 78c(a) ). . Section 101(5) of the Federal Credit Union Act ( 12 U.S.C. 1752(5) ) is amended by striking State law and inserting State law: .
Provided further : That in no case may such terms include a digital asset (as defined in section 1a of the Commodity Exchange Act (7 U.S.C 1a)) or digital asset security (as defined in section 3(a) of the Securities Exchange Act of 1934 ( 15 U.S.C. 78c(a) )
