Sec. 2604. Space situational awareness data, information, and services: provision to non-United States Government entities

Chapter 507 of title 51, United States Code, is amended by adding at the end the following: Pursuant to the authority provided in section 50702, the Director of Space Commerce, in coordination with appropriate entities within the Department of Commerce and the heads of other relevant Federal agencies— shall carry out a program to improve the collection, processing, and dissemination of space situational awareness data, information, and services; subject to paragraph (2), may provide such data, information, and services to 1 or more eligible entities described in subsection (b); may obtain such data, information, and services from 1 or more such eligible entities; and not later than 180 days after the date of the enactment of this section, shall obtain data or services from 1 or more United States commercial entities, to be stored in an open-architecture data repository that uses commercially available cloud-based computing platforms and other analytic or visualization capabilities.
Data and information provided to eligible entities under paragraph (1)(B) shall be safety-related and unclassified. The Secretary of Commerce, in consultation with the Secretary of Defense and the heads of other relevant Federal agencies, shall develop a policy to determine the type of information that may be provided under paragraph
(1)without compromising the national security interests of the United States. An eligible entity described in this subsection is any non-United States Government entity, including— a State; a political subdivision of a State; a United States commercial entity; the government of a foreign country; and a foreign commercial entity. The Secretary of Commerce shall designate a basic level of space situational awareness data, information, and services to be provided at no charge to 1 or more eligible entities described in subsection (b), which shall include public services, free of charge, such as— a public catalog of tracked space objects; emergency conjunction notifications; and any other data or services the Director of Space Commerce considers appropriate. The Secretary of Commerce may only provide data or services under paragraph (1)(C) that compete with products offered by United States commercial entities if the provision of such data or services is required to address a threat to space safety. The Secretary of Commerce may undertake activities to promote the development of advanced space situational awareness data, information, and services to foster the growth of a global space safety industry. The Secretary of Commerce shall establish procedures by which the authority under this section shall be carried out. The United States, any agency or instrumentality thereof, and any individual, firm, corporation, or other person acting for the United States shall be immune from any suit in any court for any cause of action arising from the provision or receipt of space situational awareness data, information, or services, whether or not provided in accordance with this section, or any related action or omission. There is authorized to be appropriated to the Secretary of Commerce to carry out this chapter $15,000,000 for fiscal year 2021. .
