Section 137(a)(5) of the 1990 Act shall be applied as if the following were inserted before the period: “, or has submitted a request for administrative relief pursuant to the policy established in the memorandum of the Secretary of Homeland Security dated June 15, 2012, and entitled ‘Exercising Prosecutorial Discretion with Respect to Individuals Who Came to the United States as Children’ (Deferred Action for Childhood Arrivals)”. Section 146(a)(3) of the 1990 Act shall be applied as if the following were inserted before the period:
