Section 484 of the HEA ( 20 U.S.C. 1091 ) is amended— in subsection (a)(5) by inserting a DACA recipient as defined in subsection (u), have temporary protected status under section 244 of the Immigration and Nationality Act ( after 8 U.S.C. 1254a ), a permanent resident of the United States, ; and by adding at the end the following new subsection: In this section, the term DACA recipient means an alien (as defined in section 101(a)(3) of the Immigration and Nationality Act ( 8 U.S.C. 1101(a)(3) ) who is inadmissible to the United State or deportable from the United States under the immigration laws (as defined in section 101(a)(17) of the Immigration and Nationality Act ( 8 U.S.C. 1101(a)(17) ) and who the Secretary of Homeland Security has, in his or her discretion, determined should be afforded a grant of deferred action under the Deferred Action for Childhood Arrivals
(DACA)policy. . This section, and the amendments made by this section, shall take effect on July 1, 2022.
