Except as provided in subsection (b), none of the funds authorized to be appropriated by this Act or otherwise made available for fiscal year 2022 for the National Nuclear Security Administration may be obligated or expended to reconvert or retire a W76–2 warhead. The Administrator for Nuclear Security may waive the prohibition in subsection
(a)if the Administrator, in consultation with the Secretary of Defense, the Director of National Intelligence, and the Chairman of the Joint Chiefs of Staff, certifies to the congressional defense committees that Russia and China do not possess naval capabilities similar to the W76–2 warhead in the active stockpiles of the respective country.
