Sec. 134. Minimum inventory of tactical airlift aircraft and limitation on modification of Air National Guard tactical airlift flying missions

During the period beginning on October 1, 2021, and ending on October 1, 2026, the Secretary of the Air Force shall maintain a total inventory of tactical airlift aircraft of not less than 279 aircraft. The Secretary of the Air Force may reduce the number of tactical airlift aircraft in the Air Force below the minimum number specified in subsection
(a)if the Secretary determines, on a case-by-case basis, that an aircraft is no longer mission capable because of a mishap or other damage. The Secretary of the Air Force may not modify the flying mission of a tactical airlift unit of the Air National Guard unless— the Secretary and the Governor of the State concerned agree, in writing, to such modification; and the Secretary submits to the congressional defense committees a copy of such agreement together with an explanation of the reasons for such modification.
