The head of a Federal department or agency (as defined in section 102 of title 40, United States Code) shall initiate a debarment proceeding with respect to a person for whom information regarding four or more willful or repeated violation of the Fair Labor Standards Act of 1938 ( 29 U.S.C. 201 et seq. ) as determined by a disposition described under subsection (c)(1) of section 2313 of title 41, United States Code, and issued in the last four years, is included in the database established under subsection
(a)of such section. The head of the department or agency shall use discretion in determining whether the debarment is temporary or permanent.
